These Terms of Service govern your access to and use of San Diego Travels. The site is operated by The Travel Spark Company LLC. By using the site, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the site.
1. Independent informational guide
San Diego Travels is an independent informational travel guide. It is not a governmental agency, official tourism authority, destination marketing organization, park authority, transportation provider, tour operator, travel agency, hotel, or booking platform. References to a destination, agency, landmark, business, community, or provider do not imply sponsorship, endorsement, partnership, or official status.
Editorial material is provided for general planning and inspiration. It is not legal, medical, safety, financial, immigration, weather, navigation, or professional advice. Conditions can change after an article is published. Before relying on information about access, closures, trails, tides, weather, transportation, accessibility, reservations, entry requirements, prices, schedules, or public safety, confirm it with the responsible official source or provider.
2. Eligibility and acceptable use
You may use the site only if you can legally agree to these Terms. If you use the site on behalf of an organization, you represent that you have authority to bind that organization. You are responsible for your device, connection, and compliance with laws that apply to you.
You must not:
- use the site for an unlawful, fraudulent, deceptive, abusive, or harmful purpose;

3. Editorial information
We aim to publish useful, geographically accurate information, but we do not promise that every statement is complete, current, or error-free. A place may close, a route may change, a trail may become unsafe, a transit service may be altered, or a policy may differ from what was previously available. Photographs can also show conditions that are not present during your visit.
You remain responsible for evaluating a plan and for decisions made during travel. Consider weather, terrain, tides, wildfire or flood conditions, personal health, mobility, local rules, required permits, official warnings, and the needs of everyone in your group. Do not enter a closed area, ignore official instructions, approach wildlife, damage habitat or public art, or assume a location is safe because it appears on the site.
4. Provider listings, affiliate links, and transactions
The site may show tours, activities, accommodations, or other products supplied by third parties. Those listings may include information transmitted by an independent provider, such as descriptions, images, availability, duration, ratings, reviews, prices, and booking terms. The provider, not San Diego Travels, controls and is responsible for that data and for any transaction.
Some external links may be affiliate links. If you follow one and complete a qualifying transaction, the site may receive a commission, potentially without changing the price offered to you. Affiliate compensation does not convert San Diego Travels into the seller, operator, or contracting party.
Before booking, review the provider’s current description, total price, taxes and fees, cancellation and refund policy, accessibility information, meeting location, age or health restrictions, insurance terms, and other conditions. Questions, changes, disputes, chargebacks, refunds, cancellations, injuries, lost property, service failures, and transaction issues must generally be addressed with the provider or platform identified in your confirmation. Your transaction is governed by that party’s terms and privacy policy.
5. No endorsement or guarantee
A link, listing, photograph, mention, or category placement does not guarantee quality, safety, legality, availability, accessibility, suitability, or a particular outcome. User ratings and reviews, when displayed, come from the relevant provider system and are not independent findings by San Diego Travels. We do not guarantee that a provider will accept a booking, perform a service as described, or resolve a complaint in a particular way.
6. Intellectual property
The site and its original text, visual identity, layout, graphics, and other protected material are owned by The Travel Spark Company LLC or used under license, except where another owner is identified. Destination names, business names, public-agency names, provider marks, photographs, and other third-party material remain the property of their respective owners.
You may view the site and make a reasonable personal copy for noncommercial travel planning. No other license is granted. Uses permitted by applicable law, including fair use where it applies, remain unaffected. Requests to reproduce original site material may be submitted through the Contact page.
7. Copyright and rights concerns
If you believe material on the site infringes a copyright, trademark, privacy right, publicity right, or another protected interest, send a clear notice through the Contact page. Include identification of the work or right, the specific URL and material at issue, your contact information, the basis for your claim, and any authority to act for the rights holder. We may request additional information needed to evaluate the notice.
8. Messages, corrections, and submissions
When you contact the site, you represent that your message is lawful and that you have the right to provide its contents. Do not submit confidential material, trade secrets, payment-card details, passwords, or sensitive personal information. A correction request does not create an obligation to publish, remove, or revise material, although we may review useful evidence.
You retain ownership of original material you submit. You grant us a nonexclusive, worldwide, royalty-free license to use, reproduce, and adapt that material only as reasonably necessary to evaluate the message, respond, document a correction, protect the site, or publish material when you have clearly requested or authorized publication. This license does not require us to publish a submission.

11. Limitation of liability
To the fullest extent permitted by applicable law, The Travel Spark Company LLC and its owners, officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, travel time, or anticipated savings, arising from or related to the site, a third-party service, a provider transaction, or these Terms.
To the fullest extent permitted by applicable law, the total aggregate liability for all claims arising from or related to the site or these Terms will not exceed the greater of the amount you paid directly to The Travel Spark Company LLC for use of the site during the twelve months before the event giving rise to the claim or one hundred United States dollars. Payments made to an independent booking provider are not payments made directly to the site operator. Limitations that are not enforceable in a particular jurisdiction apply only to the maximum extent permitted there.
12. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless The Travel Spark Company LLC and its owners, officers, employees, contractors, licensors, and service providers from claims, damages, obligations, losses, liabilities, costs, and expenses arising from your unlawful use of the site, your material violation of these Terms, or your violation of another person’s rights. This section does not require indemnification for conduct that cannot lawfully be assigned to you.
13. Governing law and disputes
These Terms and any dispute arising from or relating to them or the site are governed by the laws of the jurisdiction where The Travel Spark Company LLC is organized, without regard to conflict-of-laws principles. Subject to any consumer rights or mandatory procedures that cannot be waived, the parties consent to the exclusive jurisdiction and venue of courts located in that same jurisdiction.
Before filing a claim, you agree to send a written description of the dispute through the Contact page and allow a reasonable opportunity for an informal response. This informal step does not extend a legal deadline or require either party to settle.
14. Changes, suspension, and termination
We may modify, suspend, or discontinue any part of the site, and may restrict access when reasonably necessary for maintenance, security, legal compliance, or protection against abuse. We may update these Terms by posting a revised version with a new effective date. If a change is material, an additional notice may be provided where appropriate. Continued use after the revised Terms take effect constitutes acceptance of the updated Terms.
15. General provisions
These Terms and the Privacy Policy are the entire agreement between you and the site operator concerning use of San Diego Travels, except for any separate written agreement that expressly applies. If a provision is found unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. You may not transfer your rights or obligations under these Terms without written consent. We may assign these Terms in connection with a reorganization, financing, merger, acquisition, or transfer of the business or site.
